San Francisco Boys Chorus Sued for Disability Discrimination After Expelling 7-Year-Old With Autism

Federal lawsuit alleges the Chorus ignored accommodation requests and excluded a young singer because of his disability 


San Francisco, CA — Civil rights attorney Gabriela M. Torres filed a federal lawsuit against the San Francisco Boys Chorus (SFBC) on behalf of a minor with autism, alleging violations of the Americans with Disabilities Act (ADA) and California civil-rights laws. The complaint describes how SFBC removed the child, identified as X.Y., from a required overnight camp and then expelled him from the program altogether—despite his mother’s repeated efforts to secure simple, reasonable accommodations that would have allowed him to participate safely and successfully. 


According to the lawsuit, SFBC ignored pre-camp accommodation requests, failed to conduct a fair and age-appropriate investigation concerning peer incidents, and excluded the boy from further participation based on behaviors linked to his disability. 


“My son loved singing with the Chorus until I disclosed his diagnosis,” said Kiki Tung, X.Y.’s mother. “After that, his behaviors were constantly scrutinized. Instead of supporting him, they pushed him out.” 


“No child should be shut out of music or community because of disability,” said Gabriela M. Torres, attorney for the family. “This case is about ensuring programs like SFBC follow the law, provide reasonable accommodations, and build inclusive environments where every child has the chance to belong and thrive.” 


The lawsuit seeks an injunction requiring SFBC to implement disability-inclusive policies, conduct staff training, and adopt fair investigation procedures, along with damages under California law.
